You are Eligible for Benefits From a Class Action Settlement

A proposed settlement has been reached with T-Mobile over the data breach that T-Mobile announced on August 16, 2021, where T-Mobile’s computer network system was the target of a criminal cyberattack (the “Data Breach”). Plaintiffs claim that T-Mobile did not adequately protect their personal information. T-Mobile denies any wrongdoing. No judgment or determination of wrongdoing has been made.

Who is Included? You received this reminder email because records indicate you are included in this Settlement as a Settlement Class Member. The Settlement Class includes the approximately 76 million U.S. residents identified by T-Mobile whose information was compromised in the Data Breach.

What does the Settlement Provide? T-Mobile will establish a $350 million Settlement Fund that will be used to pay for cash payments of up to $25,000 for reimbursement of Out-of-Pocket Losses and Lost Time that you believe are fairly traceable to the Data Breach (or alternatively a cash payment of $25 ($100 in California)), two years of free Identity Defense Services, two years of free Restoration Services, Attorneys’ Fees and Expenses, Service Awards to Class Representatives, and costs of notice and administration. All cash payments may be adjusted pro rata depending on the number and amount of claims submitted.

How To Get Benefits: You must submit a claim form, including any required documentation to receive any cash or Identity Defense Services. (You do not need to file a claim to access the Restoration Services.) The deadline to file a claim form is January 23, 2023. You can easily file a claim online at www.t-mobilesettlement.com. You can also get a paper claim form at the website or by calling toll free 1-833-512-2314, and file by mail, which must be mailed and postmarked by January 23, 2023. When filing your claim use your unique Class Member ID (located at the top of this email).

Your Other Options. If you file a claim form, object to the Settlement and Attorneys’ Fees and Expenses, or do nothing, you are choosing to stay in the Settlement Class. You will be legally bound by all orders of the Court, and you will not be able to start, continue or be part of any other lawsuit against T-Mobile or related parties about the Data Breach. The deadline to exclude yourself or object to the Settlement has passed. The Court has scheduled a Final Approval Hearing in this case for January 20, 2023, to consider whether to approve the Settlement, Attorneys’ Fees of up to 30% of the Settlement Fund plus Expenses, Service Awards of up to $2,500 for Class Representatives, as well as any objections. You or your own lawyer, if you have one, may ask to appear and speak at the Final Approval Hearing at your own cost, but you do not have to.
